Terms and Conditions for the FlixFox App

Before using Our Service, please read these Terms and Conditions.

1. Interpretation and Definitions

Interpretation

Capitalized terms have meanings described below. The terms defined below have the following meaning, irrespective of whether they are used in the singular or plural form.

Definitions

For the purpose of these Terms:

● Application means the FlixFox software application you have downloaded to any handheld or electronic device, ( “FlixFox application" ).

● Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to FlixFox.

● Country refers to: India.

● Device includes any device (such as a cellphone, smart TV or digital tablet) which is capable of accessing the Service.

● For the purposes of this Agreement, Personal Data means any information relating to an identified or identifiable individual.

● Premium is a subscription-based feature within the Application that enables access to certain features and additional content, including for example, without limitation, ad-free streaming.

● “Promotions” Promotion” means promotion program(s) offered by STAR88 that allow the user(s) to earn cash or other rewards.

● Service means the Application and all Content and Services made available to, through or in connection with the Application.

● Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company and replaces all prior and contemporaneous agreements, communications and proposals, whether oral or written, with respect to the Website or Service.

● Third-Party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service (e.g., an enabling feature such as a social network “plug in”).

● You refer to the person accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.

2. Acknowledgment

These Terms and Conditions form a legally binding agreement between You and the Company governing Your use of the Service. Your access to and use of the Service is based on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. If You disagree with any part of these Terms then You may not access the Service.

You acknowledge that you are 18 years of age or older. The Service is not available to individuals who are under 18 years old.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of Ours. Before using Our Service, please also see Our Privacy Policy carefully.

3. User Accounts

Registration – You must register an Account with Us and the registration details provided by You must be accurate and complete. You are responsible for maintaining the confidentiality of the password You use to access the Service, and for all activities that occur under Your password. You agree to notify Us as soon as You become aware of any unauthorized use of Your account or password or any other breach of security.

4. Subscriptions, Promotions, and Content

Premium Subscriptions

Some parts of the Service are only available if you have paid a subscription or one-off usage fee or fee. Your payment is processed in advance on a recurring periodic (e.g., monthly, yearly) basis (each, a “billing cycle”) based on the subscription plan you choose. Exclusive access can also be obtained via valid redeemable codes.

Promotions and Referral Rewards

The Application may also provide certain promotional opportunities such as referrals to customers to earn cash back (e.g. our "Earn Cash by Inviting" program). Participation is bound by the terms of the promotion. The Company uses an anti-cheating mechanism for detection of deceitful activities. In the event that You are in breach of any of the promotion rules, We reserve the right to: refuse access to the promotion; disqualify You from the program; and/or withhold any promotional monies due to you.

Content and Service Availability

The service has an extensive content library, some of which is free and ad-supported. Some content is only available to Premium users. Content may become available (or be removed) over time, though the client his/herself will not be notified of this.

5. Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company. We have no control over and are not responsible for the content, privacy policies or practices of any third party sites or services. We encourage You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

6. Termination

You agree that we may suspend or terminate Your access at any time for any reason without notice or liability. Termination When you have the right to use the Service is terminated in any way, your right to use the Service will end immediately.

7. Limitation of Liability

Under no circumstances, including, without limitation, the Company’s negligence, shall the Company or its suppliers be liable for any consequential, incidental, special, indirect, or direct damages. Some of the above limitations may not apply to you, as it depends upon the jurisdiction in which you reside; those jurisdictions may not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages. To the extent that Liability cannot be disclaimed, it will be disclaimed only to the furthest extent possible under the applicable law in these states.

8. “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You as is and as available and with all faults and defects without warranty of any kind. The Company makes no warranty or undertaking that the Service will meet Your requirements, that it will be uninterrupted, timely, secure, or error-free, that the servers or content will be free from viruses or other harmful components.

9. Governing Law

These Terms and Your use of the Service are governed by the laws of the Country, excluding its conflicts of law rules. In addition to these terms, your use of the Application is also subject to applicable local, state, national or international laws.

10. Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company before filing a claim in the court of law.

11. Severability and Waiver

● Severability: If any provision of these Terms is deemed to be unenforceable or invalid, all other provisions shall remain in full force and effect.

● Waiver: The waiver of a breach of any term of these Terms will not be considered a waiver of any other term or of Concured’s right to require strict observance of each of the terms herein.

12. Changes to These Terms and Conditions

We reserve the sole right to make Free changes in these Terms at any time. If any material changes are made to this Agreement, We will make reasonable effort to inform You prior to such changes taking effect. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
